In re Adoption of N.J.A.C. 5:96 & 5:97 by N.J. Council on Affordable Housing, 221 N.J. 1 (2015), the N. J. Supreme Court determined that municipalities must submit to judicial review for a determination of their obligation to provide for affordable housing, and may file a declaratory judgment action along with a motion for temporary immunity from “builder’s remedy” lawsuits as well as entry of a judgment of compliance and order of repose, protecting it from such suits.
