Every Municipality in the State of New Jersey has a constitutional obligation to provide realistic affordable housing opportunities under the Fair Housing Act of 1986. In order to meet this requirement, the Township of South Brunswick has established the Affordable Housing Office which is dedicated to this purpose.
WHAT IS AFFORDABLE HOUSING?
The Fair Housing Act (P.L. 1985 - Chapter 222) was enacted by the New Jersey State Legislature to increase the supply of housing in New Jersey that is available to households whose total gross annual income falls below 80% of an authorized median income guideline.
Affordable housing units are restricted for limited time periods to occupancy by households that have been certified as income eligible. Any housing that has been designated, as low and moderate-income housing will also be subject to restrictions that enable them to be rented or sold only to income-qualified households. Affordable Housing units initial rents, sales prices and re-sales and re-rentals will be controlled by utilizing a system of adjustment based on approved median income guidelines.
Basic eligibility is determined by GROSS annual household income. Income includes, but is not limited to, wages, salaries, regularly scheduled overtime, tips, commissions, alimony, verified regular child support, Social Security benefits, unemployment, AFDC, Disability or Pensions, business income and actual or imputed earnings from assets which include savings bank accounts, CD's, money market, mutual funds, stocks and bonds, or other securities, and real estate. Complete income information is essential.
When housing is ready for occupancy, households who have been selected and whose gross annual income and household size meet the requirements for occupancy of a unit in their range of affordability will be notified and scheduled for a certification interview. At this interview, every household member 18 years of age or older who will live in the affordable unit shall be required to document all income. In addition, credit background reports will be required to document credit worthiness. Only those households whose income has been certified will be referred to the developer, seller or landlord for final negotiations. Households who buy or rent an affordable unit are required to use this unit as their primary residence.
If you are seeking to purchase a home, you must be able to qualify for a mortgage and have the ability to make a reasonable down payment at the time of purchase. If you are seeking to rent a unit, you must be able to make the required security deposit. In New Jersey, landlords have the authority to collect up to one and one-half times the amount of one month's rent as a security deposit.
All information included in the preliminary application and any additional information that may be requested subsequently will be kept in strict confidence, in accordance with any applicable law or any provision thereof. Any request for information relating to your application from sources other than those associated with the Affordable Housing Office will not generally be honored without your written consent. All information acquired is to be used solely for the purpose of determining eligibility for affordable housing.
